An audit for Preliminary Tax Crime Evidence (Pemeriksaan Bukti Permulaan or "Bukper") is an examination carried out by the tax authority to obtain Preliminary Evidence – namely in the form of circumstances, actions, and/or evidence in the form of statements, writing, or objects – which can provide valid proof that there is or has been a criminal act in the field of taxation that can cause losses to state revenue.
Bukper must be handled very carefully because they are only one step away from being escalated to an Investigation and turning a Taxpayer into a "suspect". Due to the severe legal threat looming, Taxpayers may be on an unequal playing field during the Bukper process. In that context, the Constitutional Court recently issued Decision Number 83/PUU-XXI/2023.
