Standard clauses (Klausula Baku) are a crucial tool of businesses in dealing with end-consumers, and consumers have come to rely on those clauses. This is not surprising as standard clauses greatly benefit both parties, giving a great degree of ease and certainty in their transactions. Wisely, regulators have mostly left businesses alone to set the terms of their standard clauses, betting that their own self-interests would compel them to come up with fair standard clauses. Given the importance of such clauses, Article 18 of the Consumer Protection Law (Law No. 8 of 1999) provides a list of requirements and prohibitions on standard clauses.
In this session, HHP Law Firm has collaborated with the Jakarta Office of the Consumer Dispute Settlement Agency (BPSK) to provide you with updates on:
(i) BPSK's role in monitoring compliance with the provisions of the Consumer Protection Law on standard clauses
(ii) The common types of non-compliance with these provisions that BPSK sees and how to remedy them
The session and presentation will be delivered in Bahasa Indonesia.
