DECREE ISSUING DETAILED REGULATIONS FOR IMPLEMENTATION OF
LAW 38 ON EMPLOYMENT REGARDING UNEMPLOYMENT [JOB LOSS]2 INSURANCE

Pursuant to the Law on Organization of the Government dated 25 December 2001;

Pursuant to Law 38 on Employment dated 16 November 2013 [Law 38];

On the proposal of the Minister of Labour, or Invalids and Social Affairs [Minister of Labour],

The Government hereby issues a Decree issuing detailed regulations for implementation of Law 38 on Employment regarding unemployment [job loss] insurance.

CHAPTER 1

General Provisions

Article 1 Governing scope

This Decree provides detailed regulations for implementation of a number of articles of Law 38 on Employment regarding support for training, fostering and raising vocational skills levels in order to maintain jobs for workers; on the Unemployment Insurance Fund; on arranging unemployment insurance cover; and on the rights and obligations of agencies, units and organizations and individuals involved in the implementation of the unemployment insurance policy.

Article 2 Applicable entities
1. Employers and employees required by article 43 of Law 38 to have compulsory unemployment insurance cover.
2. Workers being managers of enterprises or co-operatives entitled to salary and who participate in compulsory social service in accordance with the Law on Social Insurance.
3. The Social Insurance Organization [SOI]; provincial Departments of Labour; and employment services centres established by a State administrative agency for employment to which duties are assigned in accordance with article 38.2 of Law 38 (hereinafter abbreviated to employment services centres or ESC).
